The terms on which we provide our website, social and supported housing services, temporary accommodation and related property management — in partnership with local authorities, housing providers and charities.
These terms should be read with our Privacy policy and Trust and safety page.
1. Introduction
These terms and conditions (“Terms”) govern your use of the Aalay Housing website and our services relating to social housing, supported housing, temporary accommodation and professional property management for landlords and partners in the East and West Midlands and as otherwise agreed. By using our site or services you agree to these Terms. If you do not agree, please do not use our services.
Nothing in these Terms reduces your statutory rights as a consumer or tenant where applicable law gives you protections that cannot be excluded.
2. What we do
Aalay Housing provides managed housing and property operations: we work with local authorities, housing associations, registered providers and charities to help place and support residents, and we manage homes to agreed standards — including compliance, repairs, resident communication and handover. Depending on the arrangement, we may act under contract with a partner organisation, a landlord, or in another role made clear to you at the time.
Specific rights and obligations relating to a tenancy, licence or placement may also be set out in separate documentation from a partner landlord or public body. Where that is the case, those documents govern the legal relationship for occupation; these Terms govern use of our website and our services as described on the site unless we expressly say otherwise in writing.
3. Enquiries and placements
Enquiries submitted through our site or other channels are subject to availability, partner criteria and our assessment. A response to an enquiry does not guarantee a placement. Fees, rent, licence charges or service charges, and any notice or termination rights, will be explained in the agreement or offer that applies to your situation — not only on this page.
4. Use of the website
You must use our website and services lawfully and in good faith. You must not submit false information, misuse our systems, harass our staff or others, or use our services for any unlawful purpose. We may suspend or restrict access if we reasonably believe you have breached these Terms, our policies, or the law.
5. Conduct, property care and antisocial behaviour
Residents and others using homes we manage must treat the property, neighbours and staff with respect, follow house rules and any tenancy or placement conditions, and allow access for safety inspections and repairs as required by law or agreement. Serious antisocial behaviour, criminal activity, violence or harassment may result in action under the relevant tenancy or placement agreement and reporting to partners or authorities where appropriate.
Landlords and partners must provide accurate information about properties and cooperate with statutory and contractual requirements for safety and management.
6. Data protection
We process personal data as described in our Privacy policy, in line with UK GDPR and the Data Protection Act 2018. By using our services you acknowledge that we may share necessary information with partner organisations involved in referrals, placements and support.
7. Limitation of liability
To the extent permitted by applicable law, Aalay Housing is not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data, arising from your use of our website or services.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law (including certain statutory rights for consumers).
We are not responsible for failures due to events outside our reasonable control (including utility failures, actions of partner organisations where we do not control them, or force majeure).
8. Changes to these Terms
We may update these Terms from time to time. The current version will be published on this page with a “Last updated” date. For material changes we may notify users where we have contact details. Continued use of our services after changes may constitute acceptance where permitted by law; if you have an ongoing contract with us, changes that affect you will be communicated as required by that contract or by law.
9. Contact and governing law
Questions about these Terms can be sent via our contact page. These Terms are governed by the laws of England and Wales. Subject to mandatory provisions giving you the right to bring proceedings in your home jurisdiction where applicable, the courts of England and Wales have exclusive jurisdiction.
